Terms of service

The arrangement in plain words: what we provide, what stays yours, and how either side walks away.

Who these are with

Brand Standard is operated by Becoming Design Office Ltd. of Victoria, British Columbia. "We" and "us" mean that company. "You" means the organisation that has a brand hub with us, and the people it gives access to.

What the service is

A private, hosted home for your brand — logo files, colours, typefaces, photography direction, written guidance and related documents — reachable by the people you invite, with each asset ready to copy and use.

Accounts and access

Accounts are created by invitation; there is no public sign-up. Whoever administers your hub decides who has access and at what level, and can remove people at any time.

You are responsible for what happens under your accounts. Keep passwords to yourself, do not share logins between people, and tell us promptly if you think an account has been compromised.

Your content stays yours

Everything you upload — logos, images, documents, text — remains your property. Nothing about using Brand Standard transfers ownership of it to us.

You grant us only the permission needed to run the service: to store your material, to display it to the people you have given access, and to make the technical copies involved in hosting and backing it up. Nothing else. We do not use your brand material to promote ourselves without asking you first, and we do not make it available to anyone outside your hub.

You confirm you have the right to upload what you upload — including fonts, photography and any licensed material.

Our platform stays ours

The software, design and structure of Brand Standard itself remain ours. You are given the right to use it while your subscription is active, not to copy, resell or rebuild it.

Fees

Fees, billing period and any setup charge are whatever we have agreed with you in writing. Unless agreed otherwise, subscriptions renew for the same period and can be cancelled before renewal. Fees already paid for a period in progress are not refunded, and we will not charge you for a renewal you told us before the date that you did not want.

Availability

We work to keep the service available and take its reliability seriously, but we do not currently offer a contractual uptime guarantee, and we will not pretend to. If your organisation requires one, raise it with us and we will discuss what is realistic rather than sign up to a number we cannot hold.

We may take the service down briefly for maintenance. Where we can plan it, we will give notice.

Acceptable use

Do not use Brand Standard to store or distribute unlawful material, to infringe anyone's rights, or to attempt to reach parts of the system you have not been given access to. We may suspend access that puts the service or other clients at risk, and we will tell you why.

Ending it

You can stop at any time by telling us. We may end the arrangement with reasonable notice, or immediately if these terms are seriously breached.

When a hub closes we delete its records and uploaded files. Ask before you go and we will give you a copy of your material — it is yours, and you should not have to argue for it.

Liability

We provide the service with reasonable care and skill. We are not liable for indirect or consequential losses, or for lost profits, revenue or goodwill. Our total liability in any twelve-month period is limited to the fees you paid us in that period.

Nothing here limits liability that cannot lawfully be limited.

Privacy

How we handle information is described in our privacy policy, which forms part of these terms.

Changes

If we change these terms we will update the date above, and tell you directly where a change materially affects you.

Governing law

These terms are governed by the laws of British Columbia and the laws of Canada that apply there, and the courts of British Columbia have jurisdiction.
